dienst was getreden, heeft zij haar werkgever op de hoogte gebracht van haar zwangerschap. Vervolgens is de arbeidsovereenkomst van de zwangere werkneemster be\u00ebindigd tijdens de proeftijd. Volgens werkneemster was dat vanwege haar zwangerschap. Volgens werkgever vanwege de houding en de prestaties van de werkneemster. De rechtbank Den Haag moest hier een oordeel over vellen (ECLI:NL:RBDHA:2024:14166).<\/strong><\/p>\n\t\t\t\t\t\t\t\t\t<\/div>\t\t\t\t\t\t\t\t\t\n\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t\t\t\t\t\t\t\t\t\t\n\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t<div class=\"page-news-and-publications-content-content-container\">\n\t\t\t\t\t\t\t\t\t<div class=\"page-news-and-publications-content-content\">\n\t\t\t\t\t\t\t\t\t\t<p>Feiten<\/p>\n<p>De gebruikelijke sollicitatieprocedure bij werkgever bestaat uit twee sollicitatiegesprekken. Vanwege twijfel over de capaciteiten van werkneemster hebben er met werkneemster drie sollicitatiegesprekken plaatsgevonden, waarna werkgever werkneemster een arbeidsovereenkomst heeft aangeboden. In de arbeidsovereenkomst is een proeftijd opgenomen tot en met 31 december 2023.<\/p>\n<p>Een dag na ontvangst van de arbeidsovereenkomst heeft werkneemster aan werkgever laten weten dat zij zwanger is. Na deze mededeling hebben partijen overleg met elkaar gevoerd over een aangepaste invulling van de arbeidsovereenkomst. Uitkomst van die gesprekken is dat werkneemster na afloop van haar zwangerschaps- en bevallingsverlof van een vijfdaagse werkweek naar een driedaagse werkweek zou gaan.<\/p>\n<p>Halverwege de eerste werkdag meldde werkneemster zich ziek en zij keerde pas ruim een week later terug. Drie dagen later zegde werkgever de arbeidsovereenkomst van werkneemster op met een beroep op het proeftijdbeding.<\/p>\n<p><strong>Standpunten partijen\u00a0<\/strong><\/p>\n<p>Werkneemster stelt dat werkgever haar dienstverband heeft be\u00ebindigd in verband met haar zwangerschap, waardoor werkgever een verboden onderscheid heeft gemaakt tussen mannen en vrouwen. Werkneemster meent daarom aanspraak te maken op een billijke vergoeding, transitievergoeding en gefixeerde schadevergoeding.<\/p>\n<p>Werkgever betwist dit en voert aan dat de opzegging van de arbeidsovereenkomst was gebaseerd op de houding van werkneemster en haar prestaties op de werkvloer. Volgens werkgever waren er al twijfels over de kwaliteiten van werkneemster voor aanvang van haar dienstverband. Aangezien werkneemster gedurende haar eerste werkweek ziek was en het einde van de proeftijd vanwege de feestdagen snel naderde, was werkgever gedwongen snel een beslissing te nemen over de voortzetting van het dienstverband van werkneemster.<\/p>\n<p><strong>Verbod op discriminatie op grond van geslacht<\/strong><\/p>\n<p>Het verbod op discriminatie verbiedt werkgevers onderscheid te maken op grond van persoonlijke kenmerken en vormt een belangrijk beginsel van het Nederlandse arbeidsrecht. Het verbod op discriminatie heeft tot doel gelijke behandeling te waarborgen en werknemers bescherming te bieden tegen onrechtvaardige behandeling op de werkvloer.<\/p>\n<p><strong>Proeftijd<\/strong><\/p>\n<p>Niet in geschil is dat er een geldige proeftijd is overeengekomen tussen partijen en dat werkgever de arbeidsovereenkomst tijdig, namelijk voor het einde van de proeftijd, heeft opgezegd. Ook bij een geldig proeftijdbeding geldt dat de opzegging tijdens de proeftijd niet op discriminerende gronden mag plaatsvinden.<\/p>\n<p><strong>Standpunten partijen<\/strong><\/p>\n<p>De kantonrechter oordeelt dat er geen sprake is van een verboden onderscheid op grond van zwangerschap. Werkneemster heeft dit volgens de kantonrechter onvoldoende onderbouwd, terwijl werkgever voldoende heeft aangetoond dat de zwangerschap van werkneemster geen reden was om tot be\u00ebindiging van het dienstverband te komen.<\/p>\n<p>Nadat werkgever op de hoogte was gebracht van de zwangerschap van werkneemster, heeft zij aan werkneemster immers een aangepaste arbeidsovereenkomst (met gewijzigd aantal werkuren) aangeboden. Ook is er een inwerkprogramma voor werkneemster opgesteld. Alleen dit wijst er volgens de kantonrechter al op dat werkgever de intentie had om na de proeftijd en de zwangerschap de samenwerking voort te zetten.<\/p>\n<p>Volgens de kantonrechter onderschrijft dit de stelling van werkgever dat zij pas in de proeftijd tot de conclusie kwam dat werkneemster niet aan de verwachtingen voldeed. Ter onderbouwing van het standpunt heeft werkgever verklaringen van medewerkers overgelegd, waaruit bleek dat men niet te spreken was over de houding van werkneemster.<\/p>\n<p>Volgens de kantonrechter was de be\u00ebindiging van de arbeidsovereenkomst dus gerechtvaardigd en om die reden werden de vorderingen van werkneemster
