Het komt dan ook regelmatig voor dat tijdens de asbestverwijdering het asbest wordt bevochtigd terwijl dit al nat is door de regen. Mag er in die situatie afgezien worden van bevochtiging? De Afdeling heeft hier op 17 juli 2024 uitspraak over gedaan.<\/p>\n\t\t\t\t\t\t\t\t\t<\/div>\t\t\t\t\t\t\t\t\t\n\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t\t\t\t\t\t\t\t\t\t\n\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t<div class=\"page-news-and-publications-content-content-container\">\n\t\t\t\t\t\t\t\t\t<div class=\"page-news-and-publications-content-content\">\n\t\t\t\t\t\t\t\t\t\t<p><strong>De situatie<\/strong><br \/>\nOp 13 oktober 2021 worden in Hedel asbestverwijderingswerkzaamheden stilgelegd door een toezichthouder van de gemeente. Op dat moment worden er door een asbestverwijderingsbedrijf sloopwerkzaamheden uitgevoerd aan met pur aan elkaar gelijmde golfplaten. De toezichthouder is van mening dat deze werkzaamheden onzorgvuldig worden uitgevoerd, waardoor onnodige emissie ontstaat terwijl daar geen maatregelen voor worden getroffen. Dit zou een overtreding zijn van de zorgplicht in het (voormalige) artikel 1.1a van de Wet Milieubeheer.<\/p>\n<p><strong>Hoe oordeelt de Afdeling?<\/strong><br \/>\nDe saneerder stelt de zorgplicht niet te hebben overtreden en betoogt dat de golfplaten al nat waren door regen en dauw en dat het daarom op grond van het Certificatieschema niet verplicht zou zijn om nog aanvullende maatregelen te treffen. Dit wordt onderbouwd door de weergegevens van die dag en een rapport van een adviesbureau.<\/p>\n<p>Het college van B&amp;W stelt daarentegen dat bevochtiging door enkel regen en dauw onvoldoende is omdat dat vocht de kern van de golfplaten en de overlappende delen van de golfplaten niet kan bereiken.<\/p>\n<p>De Afdeling stelt allereerst vast dat de zorgplicht volgend uit artikel 1.1a van de Wet Milieubeheer nader wordt ingevuld door de regels in het Certificatieschema voor de Procescertificaten Asbestinventarisatie en Asbestverwijdering. De Afdeling oordeelt dan, onder verwijzing naar een advies van een adviesbureau, dat de saneerder onvoldoende heeft aangetoond dat de gehele golfplaten zo nat waren dat bevochtiging overbodig was. In het door de Afdeling aangehaalde advies wordt opgemerkt dat bevochtiging van golfplaten slechts beperkt bijdraagt aan het beperken van emissie omdat \u00e9\u00e9n van de functies van golfplaten juist het tegenhouden van regen is. Daaraan wordt toegevoegd dat het daarom essentieel is om adequate beheersmaatregelen, zoals een waternevel, te treffen tijdens de asbestverwijdering. De Afdeling concludeert dat een waternevel ervoor zorgt dat alle vrijkomende asbestvezels, ook delen van de golfplaat die nog niet nat waren, daardoor zo snel mogelijk neerslaan.<\/p>\n<p>Daarnaast is de Afdeling van oordeel dat de opvatting van het asbestverwijderingsbedrijf dat verneveling geen vorm van bevochtiging is en bevochtiging daarnaast enkel vooraf plaats dient te vinden, een onjuiste uitleg van artikel 43 lid 5 van het Certificatieschema is. In dat artikellid wordt namelijk ook expliciet benoemd dat het gaat om bevochtiging \u2018bij verwijdering\u2019. Het voorgaande leidt tot het oordeel dat het asbestverwijderingsbedrijf niet alle maatregelen heeft genomen die redelijkerwijs van haar gevraagd mochten worden. De overtreding is dan ook volgens de Afdeling terecht vastgesteld.<\/p>\n<p><strong>Conclusies en advies<\/strong><br \/>\nDeze uitspraak bevat een aantal interessante facetten. Allereerst uiteraard een heel praktische omtrent de eis om het te verwijderen asbesthoudende materiaal te bevochtigen. Hierin kan geconcludeerd worden dat bij asbesthoudende toepassingen waar breuk niet kan worden voorkomen, enkel bevochtiging vooraf niet voldoende is. Bevochtiging dient plaats te vinden gedurende de asbestverwijdering. Wat deze uitspraak van de Afdeling tegelijkertijd echter niet duidelijk maakt, is of bevochtiging nog steeds nodig is wanneer het tijdens de asbestverwijdering voortdurend regent.<\/p>\n<p>Daarnaast valt op dat de Afdeling het Certificatieschema gebruikt om een zorgplicht uit de Wet Milieubeheer in te vullen. In het kort houdt deze zorgplicht in dat nadelige gevolgen voor de fysieke leefomgeving in beginsel geheel moeten worden voorkomen door het nemen van alle maatregelen die redelijkerwijs gevraagd kunnen worden. Indien nadelige gevolgen niet kunnen worden voorkomen, moeten deze gevolgen zoveel mogelijk beperkt of ongedaan gemaakt worden. Als ook dat geen mogelijkheid is, moet de activiteit geheel achterwege gelaten worden voor zover dat dat redelijkerwijs mogelijk is.<\/p>\n<p>Artikel 1.1a van de Wet Milieubeheer is met de inwerkingtreding van de Omgevingswet op 1 januari 2024 vervallen, maar in de Omgevingswet bevat een soortgelijke zorgplicht onder andere artikelen 1.6 en 1.7. Als de Afdeling de in deze uitspraak ingezette lijn voortzet, sluiten wij niet uit dat toezichthouders op milieuregelgeving mogelijk via deze zorgplicht handhavend zullen gaan optreden bij overtredingen van het Certificatieschema.
